01The agreement
These Terms of Use (“Terms”) are an agreement between you and [Cohab legal entity name] (“Cohab,” “we,” “us”). They cover the Cohab iPhone app, the website at cohabnow.com, and the membership and services we provide through them (together, the “Service”).
By creating an account, applying, or using the Service, you agree to these Terms, our Community Guidelines and our Privacy Policy. If you don’t agree, don’t use the Service.
Your license to the app itself is also governed by Apple’s Licensed Application End User License Agreement. If that agreement and these Terms conflict about the app license, Apple’s agreement controls. These Terms govern your membership and how you use Cohab.
02Who can join
- You must be at least 18 years old. When you create an account, you confirm that you are. We may ask for proof of age and close any account we believe belongs to someone under 18.
- You must be looking for, or offering, a shared home in a city where Cohab operates (currently New York and Miami).
- You may hold only one account. It is personal to you and can’t be shared, sold or transferred.
- You may not use Cohab if we have previously removed you, or if you are legally prohibited from using it.
03Applications & the committee
Cohab is application-reviewed. You complete an interview of questions and photos, and a review committee reads it. In submitting an application you confirm that everything in it is true, current and about you.
- Review takes time. Allow a minimum of 72 hours for a decision. Applications are read in the order received; applicants invited by a member are reviewed in a shorter queue.
- Acceptance is not guaranteed. The committee decides at its discretion and may decline, waitlist or defer an application without giving a reason.
- Invitations. Members receive a limited number of invitations (currently three). They are personal, may not be sold or traded, and moving up the queue is not the same as being accepted.
04Membership & billing
Once accepted, you join by buying a Quarterly Membership: an auto-renewable subscription sold through Apple’s App Store, currently US$19.99 every 3 months. Prices shown in the app are set by Apple for your region and may include tax.
- Payment is charged to your Apple Account when you confirm the purchase.
- Your membership renews automatically for the same price and period unless you cancel at least 24 hours before the end of the current period.
- Your Apple Account is charged for renewal within the 24 hours before the current period ends.
- You can manage or cancel at any time in your Apple Account settings (iPhone Settings › your name › Subscriptions), or at apps.apple.com/account/subscriptions. Cancelling stops the next renewal; your membership stays active until the end of the period you already paid for.
- Deleting your account or the app does not cancel your subscription. Cancel through Apple as well.
Your seat after acceptance. When you’re accepted, we hold your seat for 72 hours. If you don’t start a membership within that window, the seat returns to the waitlist and you’ll need to apply again.
Refunds. Apple processes all payments, so Apple handles refund requests under its own policies, at reportaproblem.apple.com. Cohab does not issue partial refunds for unused time.
Price changes. If we change the price, Apple will notify you in advance and, where required, ask for your consent before the new price applies.
05Member conduct
Cohab works because the people inside can trust each other. When you use the Service you agree to follow our Community Guidelines, and in particular not to:
- post anything false or misleading, including photos that aren’t you, aren’t the room offered, or misrepresent it;
- harass, threaten, intimidate, stalk, demean or abuse anyone, on or off Cohab;
- post sexual, hateful, violent or otherwise objectionable content, or content involving minors;
- discriminate unlawfully, or use Cohab to break fair-housing or other laws;
- ask for or send money outside a written roommate agreement, or run any scam, including advance-fee, deposit or rental fraud;
- impersonate anyone, or create an account for someone else;
- share another member’s photos, messages or personal information outside Cohab without their permission;
- scrape, reverse-engineer, overload, or interfere with the Service, or use it for advertising or recruitment.
Cohab has zero tolerance for objectionable content and abusive users. We filter submitted text, review every report within 24 hours, and remove offending content. Members who post objectionable content or abuse others are removed from Cohab, without a warning step and without a refund from Cohab.
You can report any member or message, and block any member, from inside the app. Blocking is immediate and works both ways.
06Your content
“Your content” means everything you submit: application answers, essays and prompt answers, photos, listing details, request notes and messages.
- You keep ownership of your content.
- You grant Cohab a non-exclusive, worldwide, royalty-free license to host, store, reproduce, resize and display your content, and show it to the review committee and to other members, only to operate, secure and improve the Service. We don’t use your photos or essays in advertising without asking you separately.
- The license ends when you delete the content or your account, except for copies we must keep for legal or safety reasons (see the Privacy Policy) and short-lived backups.
- You confirm that you have the right to share your content, that your photos are accurate and recent, and that anyone else shown in a photo agreed to it being shared.
- We may screen, hide or remove any content that breaks these Terms or the Community Guidelines.
07Housing is between members
Cohab introduces people. We are not a real-estate broker, landlord, property manager or party to any lease, sublease or roommate agreement, and we don’t inspect homes or hold deposits.
- You are responsible for your own arrangements, including meeting safely, viewing the room, checking that a host is allowed to rent or sublet, and following your lease and local law.
- Verification badges (ID, income, lease) are optional and show only that a member completed that check at the time. They are not a guarantee of anyone’s identity, character or conduct.
- Never pay a deposit or rent before you’ve seen the room in person and signed a written agreement.
08Leaving & removal
You can leave anytime. Delete your account in the app (Profile › Account › Delete account), or email support@cohabnow.com. Remember to cancel your subscription through Apple.
We may suspend or remove your account, or limit what you can do, if you break these Terms or the Community Guidelines, if we must for legal reasons, or to protect members. Zero-tolerance violations lead to immediate removal. Where it’s safe and lawful, we’ll tell you why, and you can ask us to reconsider by writing to support.
Sections that by their nature should survive, including content license limits, disclaimers, limitation of liability and disputes, survive the end of your membership.
09Disclaimers
The Service is provided “as is” and “as available.” To the fullest extent the law allows, Cohab disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose and non-infringement. We don’t promise that you’ll be accepted, find a roommate or home, or that the Service will be uninterrupted or error-free.
We do not conduct criminal background checks on every member, and we are not responsible for the conduct of any member on or off the Service. Use judgment, and read our safety guidance on the Support page.
10Limitation of liability
To the fullest extent the law allows, Cohab and its people will not be liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits, data, housing or goodwill, arising from your use of the Service or from any interaction with another member.
Our total liability for any claim relating to the Service is limited to the greater of the amount you paid for membership in the 12 months before the claim, or US$100. Some places don’t allow these limits, so they may not all apply to you.
You agree to indemnify Cohab against claims arising from your content, your arrangements with other members, or your breach of these Terms.
11Governing law & disputes
These Terms are governed by the laws of [State of ___ โ founder and counsel to confirm], without regard to conflict-of-law rules. Disputes will be resolved in [courts / arbitration forum โ founder and counsel to confirm].
Before filing any claim, please email support@cohabnow.com so we can try to resolve it informally within 30 days.
12Changes & contact
We may update these Terms as Cohab grows. If a change is material, we’ll tell you in the app or by email before it takes effect. Continuing to use Cohab after that means you accept the updated Terms.
